Terms of Service

1. Acceptance of terms

By accessing or using ProFormaAI (the "Service"), operated by FortunaTerra Technologies ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of the Service

ProFormaAI is a beta real-estate deal-analysis tool. It takes inputs you provide (or that you enter via voice/NLP) and returns calculated outputs — forward ROI metrics, a max-offer calculation, and related underwriting figures. All figures the Service produces are estimates only — not financial, investment, or tax advice. You are solely responsible for verifying any number before relying on it, and for consulting a licensed financial advisor, tax professional, or real estate attorney before making any investment decision or submitting any generated document (such as a Letter of Intent) to another party.

3. Eligibility and accounts

You must be at least 18 years old to use the Service. Accounts are created and authenticated via Google Sign-In or Sign in with Apple. You're responsible for maintaining the security of your Google or Apple account and for all activity that occurs under your ProFormaAI account. Notify us promptly at hello@pfpro.ai if you suspect unauthorized use.

4. Acceptable use

You agree not to:

• Misuse the Service to violate any law.
• Attempt to access another user's account or data without authorization.
• Reverse-engineer, scrape, or overload the Service's infrastructure.
• Present documents generated by the Service to third parties as anything other than your own good-faith estimates.

We may suspend or terminate accounts that violate this section.

5. Intellectual property

The Service, including its software, calculation engine, design, and branding, is owned by FortunaTerra Technologies and protected by applicable intellectual property laws. You retain ownership of the deal and property data you input. We do not claim ownership of your data, but you grant us a limited license to process it solely to operate the Service for you (compute your analyses, save your work, and sync it across devices).

6. Disclaimers and no warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. As stated above, outputs are estimates only — not financial, investment, or tax advice — and we do not warrant that any output is accurate, complete, or suitable for any specific transaction or decision.

7. Limitation of liability

To the fullest extent permitted by law, FortunaTerra Technologies will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or investment losses, arising from your use of or reliance on the Service or its outputs, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from the Service will not exceed the amount you paid us, if any, in the twelve months before the claim arose.

8. Changes to these terms; governing law and venue

We may update these Terms as the Service evolves. Material changes will update the "Last updated" date above; continued use of the Service after a change constitutes acceptance of the revised Terms. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, and any dispute not otherwise resolved is subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

9. Entire agreement

These Terms, together with our Privacy Policy, are the entire agreement between you and FortunaTerra Technologies regarding the Service, and supersede any prior or contemporaneous representations about the Service, including anything stated in our marketing materials. If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect.

10. Indemnification

You agree to indemnify and hold FortunaTerra Technologies harmless from any claim, loss, or damage — including reasonable legal fees — arising from your misuse of the Service or from any document you generate with the Service and present to a third party.
